Omega-3 oils contain fatty acids that are known as essential fatty acids because they cannot be manufactured in your body but have to be taken in your diet. It is believed that they could also be used as a treatment in other disorders such as attention deficit disorder and dyslexia, but there is as yet no evidence that this is the case.
Omega-3 fatty acids reduce the so-called ‘bad’ low density lipoprotein (LDL) cholesterol levels and increase the high density lipoproteins (HDL) that take the cholesterol back to the liver for destruction. The end result is a reduction in the cholesterol content of the blood that can be deposited on the artery walls and promote atherosclerosis. Diets high in omega-3 fatty acids appear to lower blood pressure in those suffering from hypertension, and so reduce their chances of heart attacks and strokes.
Omega 3 oils are also natural inflammatories, and help prevent conditions involving inflammation such as arthritis, asthma and menstrual cramps.  They appear to help the immune system to fight these conditions and reduce the inflammation and its causes.
They are also important in the formation of prostaglandins that are responsible for the regulation of important functions such as blood pressure, blood clotting and immune response.  They are hormone-like substances and also control the synthesis in the body of other hormones. If the balance of fatty acids in the diet is not right, then the subsequent imbalance in prostaglandin and hormone production can lead to disease.
It is in its effect on depression and mood, however, that has surprised many in the medical, profession. Ethyl-eicosapentaenoate, known as ethyl EPA, is a constituent of omega-3 fish oil and many studies have demonstrated that this substance helps cases of depression and related disorders. However, are people justified in turning to ethyl EPA to help them be cured of this condition?
In one study involving 20 people, six out of ten people given the supplement displayed significantly reduced symptoms of depression after four weeks.  The effects were noticed as early as two weeks and many of the depression symptoms, such as worthlessness and insomnia, had improved after three weeks.  This conformed with the results of many other studies that have been carried out world wide.  In Scotland, a number of patients were studied who had failed to respond to traditional antidepressant drugs. Of the seventy patients involved in the trial, all of the patients who were treated with EPA displayed significant improvements in all the symptoms of their depression after four weeks whereas those with the placebo showed no improvement.
Of the two main components of omega-3 fish oil, EPA and docosahexaenoic acid (DHA), only the EPA has this property, and the EPA works best alone when the DHA has been extracted. Studies and tests have indicated that the DHA appears to be important for the brain’s structure, but the EPA for its function, hence the reason for the ineffectiveness of the former in relieving depression which is a function of the brain rather connected to its structure. In fact, depressed people have been found to be deficient in EPA in comparison to those not suffering from the condition.
The original idea for this originated with the late Dr. Horribin who was pioneer in researching the effects of lipids on the biochemistry of the brain as far back as the 1970s.  Since then the world-wide research has confirmed his theory. However, the reason why this theory works in practice is not yet understood.  It has been established that a diet rich in trans fats can unfavorably affect the hormones in the brain that stabilize mood, possibly due to the fats slowing down the system of messaging within the brain. This kind of effect can cause depression.
This is likely due to the slowing down of the messages passing between the synapses.  Brain cells communicate by means of chemicals that cross the synapses, or small gaps between the individual cells. They are not directly connected like normal electrical circuits. It has been theorized that the EPA speeds up the passage of these messages between neurotransmitters and neuroreceptors. Other theories have also been promoted, such as that the EPA has properties of its own that cure depression by another route altogether.
A possible clue could be in the findings of one study on a man aged 21 years old whose brain was scanned before and after EPA treatment.  The result showed in increase in the mass of brain cells after the treatment. This was contrary to the belief that brain cells could neither be generated nor grown once a person reaches maturity.
An individual suffering depression who would like to treat themselves with EPA would have to buy a lot of oily fish since high doses are needed for this level of therapy. However, it is found in high concentrations in a few supplements available on the market, and when choosing you must use the highest grade of EPA you can get, with as low a DHA content as you can find.
There is little doubt now; however, that the EPA content of molecular distiled fish oil relieves depression in some individuals, although more work is needed to prove without doubt that it is effective with all forms of depression.

However, she recommended since I am experiencing nausea and exhaustaion (a side effect they call "sedation" lol...both of which should taper off the longer I take the drug) to wait a week and then raise the dose so as to prevent having further side effects. So that is what I am doing.

The worst part of the whole process is coming into the clinic and leaving. It's located in one part of a big medical complex, and the suite it is in is clearly marked "psyciatric services" right across from the reception desk for the "breast health" center. So the ladies who see breast cancer patients all day watch me walk into the "psychiatric services" suite, as do any business suited guys who happen to be walking down the hall from some other part of the building. So I enter the waiting room, which may or may not have a variety of people in various stages of distress in it. I tell the receptionist I'm here for a research appointment, whe validates my parking ticket, and I am sent back to a different, more tiny, waiting room. Last week I got to hear a girl have a half whispered breakdown while her mother tried to comfort her.

After the whole process is over I take the walk to the patient exit. All of the questions I have been asked replay in my mind, and I start thinking about why I am there, why I'm depressed, and what it has done to me. Part of me feels like I don't belong here, with the sobbing and the sedated, while another part of me knows all too well that I need this. It starts welling up, and I get to fight with it all the way home to regain some kind of "normal."

God, I hope that part gets better.

Vitamin C increases the absorption of iron and should be avoided by people with iron overload diseases (e.g., hemochromatosis, hemosiderosis). Vitamin C helps recycle the antioxidant, vitamin E. It is widely (and mistakenly) believed that mothers who consume large amounts of vitamin C during pregnancy are at risk of giving birth to an infant with a higher-than-normal requirement for the vitamin. The concern is that the infant could suffer rebound scurvy, a vitamin C deficiency caused by not having this increased need met. Even some medical textbooks have subscribed to this theory. In fact, however, the concept of rebound scurvy in infants is supported by extremely weak evidence. Since the publication in 1965 of the report upon which this mistaken notion is based, millions of women have consumed high amounts of vitamin C during pregnancy and not a single new case of rebound scurvy has been reported. A preliminary study found that people who took 500 mg per day of vitamin C supplements for one year had a greater increase in wall thickness of the carotid arteries (vessels in the neck that supply blood to the brain) than those who did not take vitamin C. Thickness of carotid artery walls is an indicator of progression of atherosclerosis. Currently, no evidence supports a cause-and-effect relationship for the outcome reported in this study. The vast preponderance of research suggests either a protective or therapeutic effect of vitamin C for heart disease, or no effect at all. People with the following conditions should consult their doctor before supplementing with vitamin C: glucose-6-phosphate dehydrogenase deficiency, iron overload (hemosiderosis or hemochromatosis), history of kidney stones, or kidney failure. It has been suggested that people who form calcium oxalate kidney stones should avoid vitamin C supplements, because vitamin C can be converted into oxalate and increase urinary oxalate. Initially, these concerns were questioned because of potential errors in the laboratory measurement of oxalate. However, using newer methodology that rules out this problem, recent evidence shows that as little as 1 gram of vitamin C per day can increase the urinary oxalate levels in some people, even those without a history of kidney stones. In one case, 8 grams per day of vitamin C led to dramatic increases in urinary oxalate excretion and kidney stone crystal formation causing bloody urine. People with a history of kidney stones should consult a doctor before taking large amounts (1 gram or more per day) of supplemental vitamin C. Despite possible therapeutic effects of vitamin C in people with diabetes at lower intakes, one case of increased blood sugar levels was reported after taking 4.5 grams per day. Certain medicines may interact with vitamin C. Refer to drug interactions for a list of those medicines.
The recommended dietary allowance (RDA) for vitamin C in nonsmoking adults is 75 mg per day for women and 90 mg per day for men. For smokers, the RDAs are 110 mg per day for women and 125 mg per day for men. Most clinical vitamin C studies have investigated the effects of a broad range of higher vitamin C intakes (1001,000 mg per day or more), often not looking for (or finding) the intake within that range. In terms of heart disease prevention, as little as 100200 mg of vitamin C appears to be adequate. Although some doctors recommend 5001,000 mg per day or more, additional research is needed to determine whether these larger amounts are necessary. Some vitamin C experts propose that adequate intake be considered 200 mg per day because of evidence that the cells of the human body do not take up any more vitamin C when larger daily amounts are used. Some scientists have recommended that healthy people take multi-gram amounts of vitamin C for the prevention of illness. However, little or no research supports this point of view and it remains controversial. Supplementing more results in an excretion level virtually identical to intake, meaning that consuming more vitamin C does not increase the amount that remains in the body. On the basis of extensive analysis of published vitamin C studies, researchers at the Linus Pauling Institute at Oregon State University have called for the RDA to be increased, but only to 120 mg. This same report reveals that . . . 90100 mg vitamin C per day is required for optimum reduction of chronic disease risk in nonsmoking men and women. Thus, the multiple gram amounts of vitamin C taken by many healthy people may be superfluous. The studies that ascertained approximately 120200 mg daily of vitamin C is correct for prevention purposes in healthy people have typically not investigated whether people suffering from various diseases can benefit from larger amounts. In the case of the common cold, a review of published trials found that amounts of 2 grams per day in children appear to be more effective than 1 gram per day in adults, suggesting that large intakes of vitamin C may be more effective than smaller amounts, at least for this condition.

When it stops and how far it drops, no one can predict with any accuracy a painful uncertainty underscored by Wall Streets giddy mood at the moment the steep descent began.
A year ago Thursday, Wall Street was celebrating the fifth anniversary of a bull market that had created $10 trillion in shareholder wealth since 2002. The Dow Jones industrial average and the Standard Poors 500 index hit all-time highs on Oct. 9, 2007.
A headline in USA Today captured the prevailing sentiment: s run could keep going for a while.
In fact, the party was over. The subprime mortgage problem that was laid bare by a decline in home values developed into a much broader credit crisis that toppled giant banks and financial institutions.
Panicked investors have been fleeing from stocks. The SP is down 37 percent from its peak of 1,565 a year ago, closing at 985 on Wednesday, and the Dow has tumbled 35 percent from 14,164 to 9,258.
Most experts dont see a recovery until theres greater stability in the housing market, banks are lending freely and employment improves.
Unlike other periods that saw precipitous drops, this one is rooted in foundering credit markets. That makes predictions more difficult than if the plunge were based on company profits or stocks alone.
When you have an environment like this where the crisis is so deeply rooted from the credit standpoint, it adds an extra layer of ambiguity and ultimately of uncertainty, said Mark Freeman, portfolio manager for Westwood Holdings Group Inc. That is what the markets are struggling with.
No turnaround is seen before 2009 or later. And there is a wide divergence of opinion on the future of this bear market, which feels unlike any other because of the $700 billion federal bailout and the collapse of investment banks.
Even with the Federal Reserve and other major central banks around the world slashing interest rates Wednesday, experts were hesitant to call a bottom.
Technical indicators tell us that were overdue for at least a short-term bounce, said Liz Ann Sonders, chief investment strategist for San Francisco-based brokerage Charles Schwab Corp. That doesnt tell us that the bear market is necessarily over.
This bear market a term often defined as a prolonged drop in stock prices of 20 percent or more already is harsher than most of the 10 bear markets since the 1930s. Those markets have lasted an average of about 16 months from peak to trough, with average stock losses of 31 percent, based on SP data.
Since the record 83 percent plunge in 1929-32, the current market is exceeded only by the drops of 49 percent in 2000-02 during the tech stock implosion and 48 percent in 1973-74 during a recession and energy crisis.
The magnitude of this decline is close to that of the dot-com collapse earlier this decade, but this time, its not just retirement accounts and stock portfolios that are being hurt. Increasingly, the availability of loans and credit is drying up, too.
Rob Arnott, chairman of Research Affiliates LLC in Newport Beach, Calif., thinks the big difference this time is that Americans are feeling increasing pain apart from the stock market.
People in 2000-02 saw their 401(k)s become 201(k)s, but the impact on their personal lives otherwise was minimal, he said. This time, it is starting to be significant. People who have home equity lines and use them to pay for holidays or buy a car are finding that their loan facilities are getting pulled. That affects the way they look at their own spending.
He predicts another six to nine months for this bear market.
Some are far more pessimistic.
Jim Cramer, the normally bullish host of CNBCs Mad Money program, caused a stir Monday when he warned investors to take whatever money they need for the next five years out of the market now. On Tuesday, he called it the most horrible market that Ive ever seen.
Money manager Peter Schiff, who has long espoused the bleakest of market views, said the Dow has a good chance to sink to 7,500 or lower. He expects the bear market to last another five years or more. That would signal a possible loss of at least 20 percent more in shareholder value.
Everybody wants to think theres a government solution to spare us the pain, said Schiff, who runs the investment firm Euro Pacific Capital Inc. in Darien, Conn. There is no government solution. All there is is more pain.
One wild card is that a recession unofficially defined as a decline in the gross domestic product for two or more consecutive quarters could seriously crimp consumer spending, which accounts for two-thirds of U.S. economic activity.
Without that money flowing into the economy, a rally in stocks may be unlikely.
Once the bear market ends, investors could still have a long wait to recover their losses. After a stock market index falls 33 percent, it has to rise 50 percent just to get back to where it started.
It took 12 1/2 years for the SP to recover its losses from the devastating three-year period ending in 1932, and four years for it to make up all of the decline from the 2000-02 market plunge.
Still, the tumbling price of stocks has also raised potential long-term buying opportunities.
Dan Seiver, a finance professor at San Diego State University, said many stocks are now cheap by fundamental evaluation methods. Investor panic, he said, is a sign the bear market may be closer to the end than the beginning.
The only time you get cheap stocks is when the world looks awful, he said. s going to give you cheap stocks when everything looks good.

Evelyn PringleIt would be difficult to find a better career than employment as a GlaxoSmithKline attorney, especially if job security is a top priority. Not a year goes by when the company is not doling out millions of dollars to defend against charges involving corporate misconduct of one kind or another.
A limited review of the companys involvement in the legal system over just the last five years reveals a clear pattern of habitual corruption. However, although Glaxo has paid billions of dollars in accumulated fines, penalties and awards to plaintiffs in civil cases, not one company official has been arrested and charged with a crime.
Glaxos latest escapade was revealed on October 5, 2006, when Bloomberg News reported that Glaxo conducted a recall of Paxil CR, a selective serotonin reuptake inhibitor antidepressant, last month because some of the pills may lack an active ingredient, but that the company did not warn patients who may be taking the useless pills.
Doctors told Bloomberg that patients who either abruptly stop taking Paxil or get inactive pills, can face the risk of suicidal thoughts, shooting pains and flu like symptoms.
The Paxil CR pills are the highest dose sold, and can cause severe withdrawal symptoms, according to Dr Stephen Ellen, a psychiatrist from the University of Massachusetts Medical School in Worcester. If it is true that patients might have gotten dummy pills without knowing it, it is outrageous, he said.
According to Glaxo, the FDA knew about the problem and approved the limited recall plan, but FDA spokeswoman, Susan Cruzan, told Bloomberg that she did not know the details of the September Paxil CR recall.
This incident is even more outrageous because back on March 4, 2005, the government cited Glaxo for the exact same wrongdoing when the FDA and the Department of Justice initiated the seizure of Paxil CR tablets after Glaxo failed to meet the standards laid out by the FDA to ensure product safety, strength, quality and purity.
Among the violations noted then by the FDA, was the finding that the tablets could split apart and patients could receive a portion of the tablets that lacks any active ingredient, or alternatively a portion that contains active ingredient and does not have the intended controlled-release effect.
The seizures followed warrants issued by the U.S. District Courts for the District of Puerto Rico and the Eastern District of Tennessee and were executed by the U.S. Marshals Service at Glaxos Cidra, Puerto Rico manufacturing facility, its Knoxville, Tennessee distribution facility, and a Puerto Rico distribution center.
The FDA said that Glaxo had voluntarily recalled some of the affected lots of Paxil CR but had failed to recall all of the affected lots and that failure resulted in the seizures by federal authorities.
FDA and the Department of Justice will not allow drug manufacturers to ignore our high public health standards for drug manufacturing, said John Taylor, FDA Associate Commissioner for Regulatory Affairs in a statement released by the agency at the time.
Once we discover a company is not following the standards, which were created to ensure safety and quality, we expect them to correct the deficiencies in an expedited manner, Mr Taylor stated.
American consumers, he said, deserve the best health care products on the market today, and companies that are not adhering to these standards cannot assure FDA and American consumers of the quality of their products.
A month and a half later, on April 28, 2005, the FDA announced that Glaxo had signed a consent decree to correct the manufacturing deficiencies at its Cidra, Puerto Rico facility.
However, the consent decree required Glaxo to post a penal bond of $650,000,000 contingent upon either successfully reconditioning the drugs seized in March 2005, or destroying them and paying the costs to the government.
To resolve the matter, Glaxo supposedly recalled all of the lots of Paxil CR made before November 2004, and agreed to an independent quality review of the manufacturing.
But now here we are in October 2005, with Glaxo still putting patients at risk due to the exact same wrongdoing.
When it comes to civil lawsuits against Glaxo, a steady stream of cases have been filed as a result of Glaxos concealment of the known dangers associated with Paxil, including an increased risk of suicide, birth defects, violence and withdrawal syndrome.
But the companys most egregious conduct, many critics say, in light of all the serious adverse effects now linked to Paxil, was the concealment of the fact that with many patients, and especially children and adolescents, Paxil does not even work.
Glaxo has clearly put profits over patients when marketing Paxil. While concealing clinical trials that showed Paxil was ineffective and could cause children to commit suicide, according to New York state Attorney General, Elliott Spitzer, Glaxo raked in $55 million by selling Paxil to adolescents and children in 2002 alone, when more than two million prescriptions were written for pediatric patients.
The Los Angeles based Baum Hedlund law firm is handling lawsuits involving Paxil related child suicides. On March 23, 2006, the firm filed a national class action lawsuit against Glaxo on behalf of the mother of Trevor Blain, an 11-year old Kansas boy who committed suicide after being prescribed Paxil, and Tonya Brooks from Texas who attempted suicide while taking Paxil.
Trevor Blain was prescribed Paxil for separation anxiety disorder in October 2000 and he immediately began having angry outbursts and sleeping problems. However being the side effects of Paxil were not discussed with his parents, they did not realize that the troubling behavior could be linked to the drug.
Trevor continued to take Paxil until early November 2000, when he hanged himself in the family laundry room using his dogs leash. After the suicide attempt, Trevor remained in a coma until he died on December 7, 2000.
Plaintiff Tonya Brooks, age 17, was prescribed Paxil in 2004 after being diagnosed with social anxiety disorder. She too became agitated, aggressive and had sleep problems but was unaware that she might be experiencing the adverse effects from Paxil.
Tonya first attempted suicide by taking an overdose of Paxil and Ambien, a sleeping medication, and when that attempt was unsuccessful, she took a pair of scissors and gouged a hole in her leg two days later and was hospitalized for several days.
The two named plaintiffs in the case seek to represent all individuals under the age of 18 in the US who attempted suicide while taking Paxil, or the families of individuals who killed themselves while taking the drug.
The lawsuits claims against Glaxo include fraud, negligence, strict liability and breach of warranty.
The Baum Hedlund firm has been handling SSRI lawsuits since 1990, and served on the Plaintiffs Steering Committee in the first suicide related case involving Prozac, the first SSRI approved by the FDA.
Baum Hedlund partner, Karen Barth Menzies leads the firms SSRI Department and was Lead Counsel for the Plaintiffs Steering Committee in Paxil Products Liability Litigation.
Ms Menzies advocacy efforts on behalf of SSRI suicide victims have not been limited to the legal arena. She has also testified on the matter before the California State Assembly and the FDAs psychopharmacologic Drugs Advisory Committee and has met with members of Congress from both the House of Representatives and the Senate regarding the risk of SSRI induced suicidality.
The firm is also now handling Paxil birth defect litigation. On July 28, 2006, Baum Hedlund filed a lawsuit on behalf of the parents of Adrian Vasquez, who was born with life-threatening birth defects on April 19, 2004, as a result of his mother unwittingly taking Paxil during pregnancy.
Adrian was born with congenital heart defects and since eight days old, he has undergone three open heart surgeries in an attempt to repair the heart defects. He will also likely have to undergo more surgeries in the future and possibly a heart transplant at some point.
The lawsuit alleges that Glaxo, “by directly and indirectly advertising, marketing, and promoting Paxil for the treatment of women during pregnancy and by placing this drug in the stream of commerce knowing that Paxil would be prescribed to pregnant women in reliance upon the representations … that Paxil was safe and effective for the treatment of women during pregnancy and without significant risk to the fetus.”
The complaint also alleges that Glaxo “did not timely warn the medical community and consumers generally that taking Paxil during pregnancy is associated with a significant increased risk of birth defects and abnormal development of the unborn child.”
In reviewing Glaxos entanglements in the legal system over the last five years, the first guilty verdict in a Paxil-related suicide case was issued on July 7, 2001, when a jury in Cheyenne, Wyoming, ordered SmithKline Beecham (now GlaxoSmithKline) to pay $6.4 million to the relatives of Donald Schell, who after taking Paxil for only 2 days, shot and killed his wife, daughter, and granddaughter before killing himself.
At trial, the jury heard the expert testimony of British psychiatrist and SSRI researcher, Dr. David Healy, who told the panel that all SSRIs could trigger suicidal and violent behavior in some patients. On the stand, Dr Healy described his own studies that showed that SSRIs could even cause one in four healthy volunteers to become agitated, and in some cases suicidal.
Healthy volunteers means the subjects were not mentally ill to begin with.
Dr. Healy further revealed internal SmithKline documents from clinical trials conducted by the company to support his findings. He presented a summary of a study involving more than 2,000 healthy volunteers, taking either a placebo or Paxil, that found that hundreds of healthy volunteers on Paxil had experienced adverse reactions, ranging from insomnia or anxiety to attempted suicide, that doctors in the study coded as or caused by Paxil.
Glaxos defense team told the jury that taking 2 Paxil pills could not have caused Mr. Schells violent and suicidal behaviors. However, the summary of the companys own study showed that some healthy volunteers experienced anxiety, nightmares, hallucinations and other side effects coded as caused by Paxil within two days.
In as early as four days, another volunteer experienced akathisia, a severe form of agitation that experts believe increases the risk of violence and suicide, and 2 other volunteers attempted suicide after taking Paxil for 11 and 18 days.
In the end, after considering all the evidence, the jury placed 80% of the blame for the tragedy on Glaxo.
Glaxo is notorious for concealing negative information from Paxil and legal experts say civil litigation has played a major role in exposing the dangers kept hidden for so long. According to Attorney Menzies, Civil lawsuits uncover internal company documents to which not even the FDA has access.Through our Paxil litigation, she notes, ve obtained documents that show a seriously troubling mentality of profit over safety and a callous disregard for the welfare of children.s about as reprehensible as you can get, Ms Menzies says.
There is certainly enough available evidence to back up that assertion. For instance, on July 15, 2003, after meeting with the Canadian regulatory agency, Health Canada, Glaxo issued a public advisory in Canada alerting pediatric patients, their parents or guardians, and healthcare professionals that until further information was available that Paxil should not be given to pediatric patients, due to concerns of a possible increased risk of suicidal thinking, suicidal attempts or self-harm.
The advisory also said, Paxil must not be used in pediatric patients with major depressive disorder due to the additional fact that studies have failed to show that Paxil was effective in this patient population.
In addition, Glaxo distributed letters to physicians in Canada and the UK, informing them that studies had failed to demonstrate the efficacy of Paxil in the pediatric population and that there was a doubling of the rate of adverse events, including emotional lability. However, Glaxo did not provide American physicians with this information.
Instead, it sent Medical Information Letters only to those physicians who specifically requested information concerning Paxil as a treatment for children and adolescents.
Glaxo also took steps to actively conceal the negative information about Paxil from the American public. In a June 10, 2003 press release in UK, Glaxo disclosed the suicidal thinking or attempts in children, and particularly in adolescents. But the companys American press release on June 19, 2003, stated that there is no evidence that Paxil is associated with an increased risk of suicidal thinking or acts in adults and that not a single person committed suicide.
The American press release also provided no safety or efficacy information about Paxil regarding its use in the treatment of pediatric patients.
The five-year litigation history of Glaxo involves many different types of cases. For instance, in April 2003, Glaxo paid $88 million and signed one in a slew of corporate integrity agreements, to settle charges that the company overcharged the Medicaid programs for Paxil and the nasal-allergy spray, Flonase, using a complex scheme that involved the re-labeling of products sold to an HMO at deeply discounted prices, to avoid the obligation to pay millions of dollars in rebates to the Medicaid program.
The Medicaid Rebate program requires Glaxo to give Medicaid the same discounts it gives to commercial customers like HMOs, hospitals and drug store chains. Drug companies have to report their lowest discount price for each Medicaid covered drug on a quarterly basis, and then pay a rebate based on that price.
To resolve another shady deal, in a February 6, 2004 press release, Glaxo announced that it had agreed to pay $175 million to settle an antitrust class action lawsuit involving the anti-inflammatory drug Relafen filed on behalf of direct purchasers, including pharmaceutical wholesalers.
This lawsuit alleged that Glaxo used patent litigation to block generic versions of Relafen from reaching the market. Glaxo filed the patent infringement lawsuits against two generic drug makers in 1997, which triggered an automatic 30-month stay of the FDAs authority to grant approval of the generic drug applications.
However, Glaxo lost the patent litigation when U.S. District Judge ruled after a trial that Glaxo had obtained the Relafen patent through fraudulent misrepresentations to the U.S. Patent and Trademark Office.
The two generic companies, Teva Pharmaceuticals USA and Eon Labs Manufacturing Inc., later filed antitrust suits alleging that Glaxos patent lawsuits were litigation filed for the purpose of maintaining a monopoly.
In regard to these lawsuits, Glaxos Februay 6, 2004 press release said, Similar actions from other plaintiffs in the Relafen antitrust matter, including claims made by Teva, chain drug stores and Eon Labs have also been settled, resulting in further payments from GSK.
And of course the press release contained the standard claim that Glaxo continues to believe that its actions were appropriate in obtaining and enforcing its patent for Relafen.
Five months after the announcement of the settlement in the patent case, on June 2, 2004, New York State Attorney General, Eliot Spitzer, issued a press release to report the filing of a lawsuit against Glaxo for concealing information about the safety and efficacy of Paxil in treating children and adolescents.
The complaint alleged that, starting in 1998, Glaxo engaged in a concerted effort to withhold negative information concerning Paxil and misrepresented data concerning the drugs safety and efficacy when prescribed for depression in children and adolescents and pointed out that Paxil has not been approved for any condition or illness in children or adolescents.
Specifically, it said, Glaxo conducted at least five studies on the use of Paxil in children and only published and disseminated one, which showed mixed results on efficacy.
